Das Finanzgericht Kassel hat mit Urteil vom 22. Februar 2018 zwar die Klage eines Automatenaufstellers abgewiesen, aber gleichzeitig die Revision zum Bundesfinanzhof zugelassen. Wieder einmal schlagen die Wellen hoch. Die Frage, ob die Umsätze aus Geldspielgeräten mit Gewinnmöglichkeit der Umsatzsteuerpflicht unterliegen… Am 22. Februar 2018 fand vor dem Finanzgericht Kassel die mündliche Verhandlung in der Sache Utikal/Finanzamt statt. Auf der Agenda stand die Frage, ob der Automatenaufsteller Utikal mit der Verbrauchssteuer, in Form der unionsrechtlich abschließend harmonisierten Mehrwertsteuer finanziell belastet werden darf.
