The study on the gambling sector in the European Union, conducted by the Swiss Institute of Comparative Law on behalf of the European Commission, confirms that there is considerable variance between the national laws and regulations in the Member States. The Study also found that these laws and regulations often lead to restrictions to the freedom to provide services and the freedom of establishment guarantees that are incompatible with existing EU Law. This also applies to the German part of the study, which is also based on the observations of Hambach & Hambach (appendix 5, p. 1761).

Die von der EU-Kommission in Auftrag gegebene Studie des Schweizerischen Instituts für Rechtsvergleichung zum Thema Glücksspiel in der EU bestätigt, dass es zwischen den Mitgliedstaaten der EU wesentliche Unterschiede in der Handhabung des Glücksspiels gibt. Wie die Studie u.a. zeigt, schränken die gesetzlichen Regelungen zum Glücksspiel in den meisten Mitgliedstaaten die Grundfreiheiten des freien Dienstleistungsverkehrs und der Niederlassungsfreiheit auf EU-rechtswidrige Art und Weise ein.

As a result of the plenary vote on the 1st reading of the EU Framework Services Directive, which took place in the European Parliament on the 16th of February 2006, gambling is no longer contained in the Directive. It is now more likely that countries will be forced to recognize that current European law already permits cross-border gambling within the EU, ultimately through European Court of Justice rulings and infringement proceedings by the Commission. When it was initiated in January 2004, the scope of the Services Directive did cover gambling but with an ultimate implementation date of 2010.

Als Ergebnis der Plenarabstimmung zur ersten Lesung der EU-Rahmenrichtlinie für Dienstleistungen, die am 16. Februar 2006 im Europäischen Parlament stattfand, ist Glücksspiel in der Richtlinie nicht mehr enthalten. Die Wahrscheinlichkeit steigt jetzt, dass Länder gezwungenermaßen anerkennen, dass geltendes europäisches Recht grenzüberschreitendes Glücksspiel innerhalb der EU bereits zulässt, und zwar aufgrund der Entscheidungen des Europäischen Gerichtshofs und der Vertragsverletzungsverfahren durch die Kommission.
